Pierce Law Firm, PC FAQs

Have a bankruptcy-related question? We have the answer. Check out these FAQs and contact us today for more information!

  • How much does bankruptcy cost?

People with less complicated financial lives usually have less expensive cases than those with more complicated ones.   If you're retired or on disability, your case may take less work and cost less than someone who has several jobs.  Their case may be simplier than someone who owns a business.  Small business cases are less complex than large businesses or multiple business cases.

We consider your entire situation and give fair, competitive quotes that match your needs, and we have decades of experience handling cases from simple to complex.

Ask us about bankruptcy options to stop foreclosures or for business owners and those with special or complicated cases.

  • Aren't attorneys expensive? If I can’t afford to pay my bills, how can I pay a lawyer?

Virtually all of our clients are having financial problems when we meet them. Our job is to be part of your financial solution, not part of the problem, and we've spent years making our services affordable. For most people, bankruptcy is one of the least expensive legal matters they will ever need.

If you've ever gone through a divorce, a custody dispute, or a lawsuit you will probably be very surprised at how quick, painless, and inexpensive a bankruptcy is by comparison. We can usually arrange a payment plan that works for you.

  • What should I look for in a bankruptcy lawyer?

Choose an attorney with many years of experience helping people with debt problems and handling Chapter 7 and Chapter 13, or even Chapter 11 bankruptcies so you can get the best range of experienced advice.  Our practice is 100% debt/credit/bankruptcy help and we have over 25 years of experience. Your attorney should be able to clearly explain the differences between a Chapter 7, Chapter 13, and Chapter 11 bankruptcy case and which one is right for you.

Choose an attorney and staff who will take the time to focus on your needs and your case.  Some attorneys offer bargain rates that come from taking many cases at once which means they can't offer the customized service, care, and options that you need and deserve.

Finally, you should feel comfortable with your lawyer and be confident in your relationship with him and his staff.  Deciding to file bankruptcy is an important process with long-term consequences. You should feel comfortable asking your attorney questions, talking about the best way to protect your interests, and taking the time to chose the best options for you.

  • Do you take clients from my area?

Yes!  We've had clients from all across Montana and handle cases in every bankruptcy division in Montana.

If you live in Missoula or Missoula County, Stevensville, Hamilton, Darby or anywhere in Ravalli County, Mineral County, Sanders County, Kalispell, Whitefish, Columbia Falls or anywhere in Flathead County, Polson or anywhere in Lake County, or Lincoln County, you live in Montana's Missoula Bankruptcy Division.

If you live in Blaine County, Great Falls or anywhere in Cascade County, Chouteau County, Fergus County, Glacier County, Hill County, Judith Basin County, Liberty County, White Sulphur Springs or Meagher County, Phillips County, Pondera County, Teton County or Toole County you live in Montana's Great Falls Bankruptcy Division.

If you live in Beaverhead County, Broadwater County, Deer Lodge County, Jefferson County, Bozeman or Gallatin County, Granite County, Helena or Lewis and Clark County, Madison County, Livingston or Park County or Butte or Silver Bow County you are in Montana's Butte Bankruptcy Division.

If you live in Big Horn County, Red Lodge or Carbon County, Carter County, Custer County, Daniels County, Dawson County, Fallon County or Garfield County, Golden Valley County, McCone County, Musselshell County, Petroleum County, Powder River County, Prairie County, Richland County, Roosevelt County, Rosebud County, Sheridan County, Stillwater County, Sweetgrass County, Treasure County, Valley County, Wheatland County, Wibaux County or Billings or  Yellowstone County, you are in Montana's Billings Bankruptcy Division.

  • Can I file bankruptcy without an attorney?

Yes, but you might not want to!  Bankruptcy rules are very technical and a mistake could cost you money or assets.

Even bankruptcy attorneys spend years learning to use the bankruptcy system to protect your assets and manage your debt.

We've met people who filed bankruptcy without an attorney (or with attorneys who weren't used to the bankruptcy system) who wished they hadn’t and asked for our help.

But don't just take our word for it! The US Federal Courts have this to say about representing yourself in your bankruptcy: “Bankruptcy has long-term financial and legal consequences - hiring a competent attorney is strongly recommended.”

  • Will I lose my assets if I file bankruptcy?

Most of the time your home, your personal and household items, your work tools, and even your vehicle are protected or "exempt" from being taken from you when you file bankruptcy.

If you have valuable things like expensive real estate, cars, toys or a business, some bankruptcy options let you keep your things while helping you with your debt.

We'll advise you about options for your specific circumstances and needs so you understand the best way to protect your assets before you file your bankruptcy case. That way, you can choose the bankruptcy option that’s best for you.

  • I'm a small business owner. If I file bankruptcy can I keep my business?

Yes!  Most of our business-owner clients choose to keep and continue running their businesses. We're experienced in advising business-owners. Be sure to ask us about the bankruptcy option that works best for you.

  • Will I have to go to court or see a judge?

Most bankruptcies only require a short (10-15 minute) phone call or video conference with your Bankruptcy Trustee.  We prepare our clients for this meeting and represent them during the meeting.  You probably won't need to go to the courthouse or see a judge (or even leave your home) to complete your bankruptcy.

  • What’s different about Pierce Law Firm?

We're compassionate and experienced.  We understand how hard it is to face financial problems and we have decades of experience offering debt help for Montana clients.

We focus on quality over quantity and we only handle bankruptcy/credit/debt cases.  We aren't focused on family law or car accident cases one day and bankruptcy the next. In fact we often advise other lawyers about how bankruptcy law affects their clients in other types of cases.  We focus on one area of law to better help you and meet your needs.

Andrew Pierce has practiced Montana bankruptcy and debtor-creditor law all across Montana for over 25 years.  And unlike many other bankruptcy firms, Pierce Law Firm has an experienced paralegal to work with you one-on-one.  We work closely with you throughout your case to understand your situation, needs, and goals to give you the best advice, representation and outcome.
